अवमानना पर एक विधिक प्रश्न



अवमानना पर एक विधिक प्रश्न

यह एक ऐसा मुद्दा है जो हमें एक लम्बे समय से परेशान कर रहा था. न्यायिक सुधार तथा प्रशासन में उत्तरदायित्व एवं पारदर्शिता के क्षेत्र में कार्य करते समय हमें बहुधा इस समस्या से रूबरू होना पड़ता ही रहता है.

जब हम मा० न्यायालय के सामने कोई मामला रखते हैं तो अक्सर मा० न्यायालय द्वारा प्रतिपक्षियों को अपनी बात शपथपथ के माध्यम से न्यायालय के सामने रखे जाने के आदेश दिए जाते हैं. अक्सर इस आदेश में शपथ पात्र एक निश्चित समय सीमा के अन्दर दायर करने की बात होती है. प्रतिवादियों की और से जवाब की जरूरत इसीलिए होती है ताकि दुसरे पक्ष की भी बात सुनी जा सके और इनके आधार पर एक निश्चित मत तक पहुंचा जा सके.

जैसा हम सभी जानते हैं लैटिन मुहावरा “ऑडी ऑल्टीरम पार्टम” जिसका शाब्दिक अर्थ हुआ “दुसरे पक्ष को भी सुनें” वह विधिक सिद्धांत है जिसके अनुसार किसी भी मामले में कोई निर्णय तब तक नहीं किया जाना चाहिए जब तक दुसरे पक्ष को अपने खिलाफ लगाए गए आरोपों का उत्तर दे पाने का अवसर नहीं दिया जाता. यह लगभग सभी विधिक प्रणालियों में पूरी दुनिया भर में न्याय का पहला नैसर्गिल सिद्धांत माना जाता है.

जहां सिद्धांत रूप में यह नियम पूरी तरह सही और जायज है, वास्तविक जीवन में इसका प्रयोग किये जाते समय कई बार इच्छुक पक्षों द्वारा इस सिद्धांत का व्यापक दुरुपयोग किये जाने की बात दिखती रहती है. जहां मा० न्यायालय का यह आदेश होता है की किसी मामले में दो या चार या आठ सप्ताह में प्रतिपर्क्षी अपनी बात शपथपत्र के माध्यम से उनके सामने रखें, प्रतिपक्षी उस का पालन किये जाने की जगह इसके प्रभाव से बचने के लिए विलम्ब करने का स्थापित और आजमाया हुआ तरीका अख्तियार करते दिख जाते हैं.

इन तमाम स्थितियों में प्रतिपक्षीगण ( जो बहुधा सरकार के अलग-अलग अंग होते हैं) ना सिर्फ नियत समय के अन्दर बल्कि उसके कई-कई महीनों के बाद भी शपथपत्र दायर नहीं करते हैं और इस प्रकार मामला स्वतः ही लंबित पड़ा रहता है. जब कभी मामला सुनवाई के लिए आता है वे यही कहते देखे जाते हैं की अभी शपथपत्र बना नहीं है और इस प्रकार न्याय की प्रक्रिया स्वतः ही लम्बी होती जाती है.   

इस स्थिति से विधिक तरीके से निबटने के एक  प्रयास में मैं और मेरी पत्नी नूतन ने मा० इलाहाबाद हाई कोर्ट, लखनऊ बेंच में कुछ अवमानना याचिकाएं दायर कीं. इन याचिकाओं में यह कहा गया था की मा० न्यायालय के आदेशों के पालन में प्रतिवादीगण द्वारा निर्धारित समयावधि के अन्दर प्रतिशपथपत्र दायर नहीं किया गया है. अतः यह न्यायालय की अवमानना की श्रेणी में है.

हमारा यह सीधा तर्क था की कंटेम्पट ऑफ़ कोर्ट्स एक्ट 1971 की धारा 2(बी) के अनुसार सिविल अवमानना का अर्थ होता है किसी भी निर्णय, डिक्री, ऑर्डर, रिट या न्यायालय की किसी अन्य प्रक्रिया की जानबूझ कर की गयी अवहेलना या न्यायालय के सम्मुख दिए गए किसी अंडरटेकिंग का जानबूझ कर पालन नहीं किया जाना. जब मा० न्यायालय किसी पक्ष को शपथपत्र प्रस्तुत करने को कहती है तो यह ना सिर्फ एक निर्देश और एक आर्डर होता है बल्कि न्यायालय के सामने दिया गया एक अंडरटेकिंग भी होता है की वह निर्धारित समय के अन्दर वस्तुस्थिति से न्यायालय को अवगत कराएगा. अतः यदि सम्बंधित पक्ष द्वारा अपना शपथपत्र महीनों और सालों तक नहीं दिया जाता है तो यह स्वाभाविक रूप से एक आर्डर और एक निर्देश की जानबूझ कर की गयी अवहेलना और एक अंडरटेकिंग का जानबूझ कर किया गया उल्लंघन है और इस रूप में न्यायालय की अवमानना की श्रेणी में आएगा.  

मा० हाई कोर्ट हमारी तर्कों से सहमत नहीं दिखी और उन्होंने अपने आदेश में कहा-“ विद्वान अधिवक्ता ने यह भी कहा की उपरोक्त निर्देशों के अनुपालन में उत्तर प्रदेश सरकार के किसी भी सचिव ने अभी तक शपथपत्र दायर नहीं किया है और इस रूप में यह न्यायालय की अवमानना है. लेकिन विद्वान अधिवक्ता द्वारा अपनी बात के पक्ष में कोई केस ला (पूर्व प्रकरण) नहीं प्रस्तुत किया गया.
विद्वान अधिवक्ता की बात सुनने और अभिलेखों के परीक्षण के बाद ऐसा प्रतीत होता है की रिट कोर्ट द्वारा पारित यह निर्देश प्रक्रियात्मक है. यदि समय से शपथपत्र दायर नहीं होता है तो रिट कोर्ट इस सम्बन्ध में एक विपरीत मंतव्य स्थापित कर सकती है अथवा मामले को देखते हुए शपथपत्र दायर करने की अवधी बढ़ा सकती है. इसके दृष्टिगत कोई अवमाना बनता नहीं दीखता है. यद्यपि वादी को यह छूट दी जाती है की यह मामला उसी न्यायालय के सामने उठाये जिसने लंबित रिट याचिका में यह आदेश निर्गत किया था. वर्तमान में कोई अवमाना बनता नहीं दिख रहा है.”

इस आदेश के परिप्रेक्ष्य में कुछ ऐसे विधिक प्रश्न हैं जो अभी भी हमारे जेहन में घूम रहे हैं जिन पर अपने जानकार मित्रों की राय चाहूँगा-
1.       जब कोर्ट द्वारा पारित निर्देश प्रक्रियात्मक है तो वह फिर भी तो वह निर्देश हुआ ही या नहीं?
2.       यदि वह निर्देश हुआ तो क्या वह कंटेम्पट ऑफ़ कोर्ट्स एक्ट Act 1971 की धारा 2(बी) के अनुसार सिविल अवमानना की श्रेणी में नहीं आएगा?
3.       क्या इस सम्बन्ध में कोई निश्चित केस ला (न्यायिक आदेश) पहले से मौजूद है?
4.       एक व्यापक समझ के व्यक्ति के रूप के रूप में आप हमारे द्वारा प्रस्तुत तर्कों पर क्या विचार रखते हैं और इनसे किस हद तक सहमत अथवा असहमत हैं?
5.       क्या आप इस मामले को आगे बढाए जाने की कोई स्थिति अथवा बल समझते हैं ?

हम तत्परतापूर्वक इस विधिक प्रश्न के सम्बन्ध में आपके आपकी प्रतिक्रिया का इंतज़ार करेंगे, जिस पर संभवतः अभी तक आखिरी शब्द नहीं कहा गया है और जो शायद विलम्ब से जवाब दाखिल करने की प्रवृत्ति को रोकने का एक महत्वपूर्ण सहायक बन सकता है और इस प्रकार त्वरित न्याय देने की दिशा में अपना सार्थक योगदान दे सकता है.

  1. I appreciate your spirit of reforming the system while staying with it as part of it. here are few points to ponder! How long can we keep trying to cure cancerous body by providing it with first aid on superficial pimples of it.
    1. The existing coercive criminal justice system with absolute discretion and protocols and practices was designed to advance the agenda of a state, sole objective of that was to perpetuate unhindered economic exploitation and it continues unabated. The complete set of business rules, regulations for the courts was designed to punish such suitors with enormous costs and delays and break their back to have admirable effect of preventing future complaints of injustice and corruption.
    All the intake system of judiciary, its laws, its language, its accountability mechanisms is to overawe Indians, most startling, these courts are run like Baniya's shop of our village, that shop is run exactly in his own name and here in judiciary also we plead "In the court of Mr..so and so ...learned..." while interacting with these below average holy cows, you will understand their capabilities and judicial senses.
    Forget about lower judiciary, come to high courts, knowing it fully well that the fellow attained position of High court judge, since he was a resource magnet and capability to please the people with that everything possible....one human can fantasies.
    2.when we have the fifty percent of SC Judges as corrupt against whom we can give afidavit, one can imagine the extent of rot. question is how long can we keep misleading and deceiving ourselves by maintaining that false aura and holier than thou attitude.
    3.what is your take on ovehauling this system, no police reforms will every succeed in isolation, until you tame the wild bulls of colonial judiciary and stop treating them as holy cows.
    4.If criminals will know of getting the divine justice within no time, if every police officer perpetrating injustice and corruption will know of meeting his fate in time bound manner, he will not dare to do it. here we have two deceptive institutions that were founded by colonial rulers, Local militia in the name of police and criminalized system of protecting criminal acts of state by mechanism named as Colonial judiciary and it is very big blot on the institution of justice. Until we introduce jury system to dominate and isolate corrupt judges with participation of community leaders in jury, people will keep dying with injustices.
    5. For Police we need to completely demilitarize, decentralize and decimate the colonial power formation with stringent local accountability mechanisms in the hands of local watch dog body of citizens that must decide operational objectives for local police and make SP BABU work in the field and hold him accountable for his command failure and supervisory failure, we need to kick out ceremonial functioning of Supervisory police officers and make them take proactive part in policing that is nothing but street job.
    I think we people must begin with survey on pattern of justice in various courts on criminal cases,civil cases.Time taken, cost factor for petetioners, at lower courts, high courts and supreme courts and draw comparative analysis with judiciary of vibrant democracies and advice people with this data on performance of judiciary, lest they keep falling victim to this colonial trap of injustice and corruption.

    Until we work on these issues in an organized manner, it will be just time pass. anyway keep it up.

  2. Martial races will have to play their role with their courage of convictions and lead communities on journey for justice by using their heads and not anymore, sacrificing their heads.
