RULES AND REGULATIONS

In these rules unless the context otherwise
requires:
(1)
Society or
Association means People’s Forum
(2)
Board means
the Executive Board of People’s Forum
(3)
General Body
means the General Body of People’s Forum
1-
Membership
of the Society
The different types of
members--------
1.
Life
members-----
Anyone who once contributes Rs 10,000 (Rupees
ten thousand only) to the Society on his free will shall be a Life member of
the Society.
2.
Special
members-----
Anyone who contributes Rs 1000 (Rupees one
thousand only) to the Society on his free will shall be a Special member of the
Society for that particular Calendar year.
3. Associates---
Anyone who contributes Rs 200 (Rupees two
hundred only) to the Society on his free will or anyone who actively
participates for the well-being of the Society shall be admitted as an Associate of the Society for that particular Calendar year.
General Terms and conditions----
• The membership shall not be transferable.
• The discretion to admit any one as a member
shall solely lie with the Board.
• The Board shall prescribe, by means of
resolutions or bye-laws, terms and conditions for all classes and types of
membership.

Termination
of membership----
1.
Due to death
2. Due to insanity or insolvency.

3. Due to harmful activities against the
Society.

kind of offence, which involves moral turpitude.

General
Body----
(1) All the members of the Society shall
constitute the General Body
(2) There shall be at least one meeting of
the General Body every year. In special circumstances meetings can be conveyed
any time.
(3) The minimum notice period for an ordinary
meeting of the General Body shall be ten days but in special circumstances
meetings can be conveyed at a notice of only 24 hours after explaining the
reasons for conveying the meeting.
(4) The Quorum required for any meeting shall
be one-third of the total membership of the General Body. But, for a meeting to
make or change or amend the rules and regulations or the Byelaws or the
Memorandum of Association, the Quorum required shall be two-third of the total
membership of the General Body.
(5) Functions and works of the Annual meeting
of the General Body-
(1) To elect the members of the Board and in
cases of vacancy, to fulfill the vacant position through elections.
(2)
To pass the Annual Budget of the Society.
(3)
To frame and pass the Annual Report of the Society.
(4) To pass and approve the amendment,
changes and additions made in the Byelaws, rules and regulations of the
society.
(5) To look after the movable and immovable
properties of the Society.
5.
Executive
Board------
(1) There shall be an Executive Board
consisting of not less than 7 and not more than 15 members who will be elected by
the General Body.
(2) The Director, the Convener and the Treasurer
shall be three of the Office bearers of the Board.
(3) The minimum notice period for an ordinary
meeting shall be seven days but in special circumstances meetings can be
conveyed at a notice of only 24 hours after explaining the reasons for
conveying the meeting.
(4) The Quorum required for any meeting shall
be one-third of the total membership of the Board. But, for certain matters prescribed
by the General Body, the Quorum required shall be two-third of the total
membership of the Board.
(5) All the Office-bearers and the members of
the Board shall remain in their office for five years after which they shall be
eligible for getting re-elected for any number of times.
(6) The vacancies arising in the
Board shall be filled by the General Body by a vote of majority for the
remaining period of the Board.
6.
Powers and
functions of the Board-----
(1) The business and affair of the Society shall
be carried on and managed by the Board and by such Office-bearers officers and
individuals as it may permit or delegate or assign under the broader guidelines
framed by the General Body.
(2) To work out the Annual Plan for the Society,
under the broad direction of the General Body
(3) To make an annual evaluation of the Society,
under the broad direction of the General Body
(4) To frame the Budget of the Society, under the
broad direction of the General Body
(2) The Board shall have all such powers
including appointment of staff as are necessary for carrying out the objects
and the works of the Society.
(3) All properties, movable or
immovable or of any kind, shall vest in the Board.
(4) All the income, earnings, movable and immovable properties of the Society shall be solely utilized and applied for the promotions of the its aims and objectives only as set forth in the Memorandum of Understanding and in accordance with the Rules and Regulations attached there with and no profit on therefore shall in any case be transferred to any one in any form. No member of the Society can lay any personal claims on any of the movable and immovable properties of the Society.
(4) All the income, earnings, movable and immovable properties of the Society shall be solely utilized and applied for the promotions of the its aims and objectives only as set forth in the Memorandum of Understanding and in accordance with the Rules and Regulations attached there with and no profit on therefore shall in any case be transferred to any one in any form. No member of the Society can lay any personal claims on any of the movable and immovable properties of the Society.
(5) The Board may delegate all or any of its
such powers and such functions and jobs to any authority, standing committee, sub-committee
or a person, as it seems fit, with the approval of the Board.
(6) The
Board may invite any person of eminence or any expert to attend the
meetings of the Board but such person shall not have any right to vote.
7. Office bearers of the Society----
(1)
Director – There shall be a Director of the Society elected by the Board from
amongst them-selves.
(2)
Convener—There shall be a Convener of the Society elected by the Board from
amongst them-selves.
(2)
Treasurer—There shall be a Treasurer of the Society elected by the Board from
amongst them-selves.
The term of office of all the Office-bearers
shall be 5 years from the date of constitution of the Board. In case of any
vacancy arising in between, the post shall be filled by the due process by the
General Body for the remaining period of the term.
8. Functions, Powers and Duties of the Director---
(1)
To coordinate all the meetings.
(2) To ensure that the affairs of the Society
are run efficiently and in accordance with the provisions of the Memorandum of
Association, Rules and Regulations and laws and bye-laws of the Society, under
the broader guidance of the General Body and the Board.
(3) On all such matters as the Director thinks
are of sufficient importance and urgency and cannot await the approval of the
Board, the Director shall take decisions on them with the help of the Convener
and shall place them before the Board for approval in the next meeting.
(4) To assign the duties and responsibilities
of Director to any of the Executive Members of the Board in case he is not able
to perform his duty because of absence or any other reasons
9. Functions, Powers and Duties of the Convener---
(1) The Convener shall be the Chief Executive
Officer of the Society and in this capacity shall be responsible for the proper
running of the day to day affair of the Society as directed by the General
Body, the Board or the Director, which include maintenance of all kinds of
records, files, books of accounts etc, annual auditing of accounts, convening
the meetings of the Board and the General Body, preparing the Annual budget of
the Society, preparing the annual activity report etc.
(2) He shall sign all deeds and documents on
behalf of the Society.
(3) In case of any Litigation, the Society
shall sue and be sued in the name of the Convener, People’s Forum.
10. Functions, Powers and Duties of the
Treasurer-
(1)
He shall be the Chief Accounts Officer of the Society and shall prepare the
Annual budget of the Society along with the Convener, shall be responsible for
upkeep of all the accounts and accounts books and Annual auditing of the
Society
11. Amendment of memorandum of Association,
Rules and Regulations of the Society and the Board.----
The memorandum of Association and the Rules
and Regulations of the Society and the Board may be amended only by the General
Body by a majority of 2/3rd members present and voting in accordance
with sections 12 of the Societies Registration Act, 1860.
12. Account of the Society---
The Account of the Society shall be remaining
in one or more Scheduled Banks, which shall be operated jointly by the Convener
and Treasurer of the Society after the approval of the Director. All
expenditure above Rs. 10,000 shall need the approval of the Board, unless it
has specially directed the Director to do so on its behalf.
13.Audit of Accounts----
Once in every year the Accounts of the
Society shall be audited by the auditors appointed by the Board, which shall be
the duty of the Treasurer.
14.Minutes---
The minutes of the meetings of the Board and
the General Body shall be prepared and kept by the Convener. The minutes shall
be duly signed by the Convener.
15.Byelaws---
(1)The Board shall have the power to make
Byelaws for carrying out the purposes of the Society.
(2)The Byelaws may be made for any of the
matters concerned with the activities of the Society and relating to its
general well being and proper functioning.
16. Dissolution of the Society----
The Society may be dissolved in accordance
with the provisions as laid down in the sections 13 and 14 of the Societies
Registration Act, 1860.
